Terms of Use
The binding agreement governing your access to and use of BestOnlinePsychiatry.com.
If you are experiencing a medical or mental-health emergency, or are thinking about harming yourself or others, call or text 988 (the Suicide & Crisis Lifeline in the United States), call 911, or go to your nearest emergency room. Do not use this Site in place of emergency help.
1. Acceptance of These Terms
These Terms of Use ("Terms") form a binding legal agreement between you and BestOnlinePsychiatry.com LLC, a New York limited liability company ("BestOnlinePsychiatry," "we," "us," or "our"), regarding your use of https://bestonlinepsychiatry.com (the "Site"). By accessing or using the Site, you agree to these Terms and to our Privacy Policy, which is incorporated here by reference. If you do not agree, do not use the Site.
2. Eligibility
The Site is intended for use by adults who are 18 years of age or older. You must be at least 18 to use the Site for personal decisions about psychiatric care or to act on any recommendations we publish. By using the Site you represent that you are at least 18 and have full legal capacity to agree to these Terms. Individuals between 13 and 17 may view general informational content only with the involvement of a parent or legal guardian. We do not knowingly permit use by anyone under 13.
3. Nature of the Content; No Medical Advice
The content on the Site, including rankings, reviews, comparisons, articles, infographics, lists of providers, and any other materials we publish (collectively, the "Content"), is provided for general informational and educational purposes only. The Content is not medical advice, psychiatric advice, psychological advice, diagnostic information, treatment recommendation, or a substitute for any of the foregoing.
- BestOnlinePsychiatry is not a licensed medical or mental-health provider, a medical practice, a clinic, a pharmacy, an insurer, or a referral service.
- Reading the Content, contacting us, or clicking outbound links to third-party providers does not create a doctor–patient, therapist–patient, or any other professional relationship between you and BestOnlinePsychiatry.
- The Content may not reflect the most current clinical guidance, FDA labeling, insurance coverage, pricing, or provider availability. Telehealth psychiatry is a rapidly evolving field and individual circumstances vary widely.
- Always seek the advice of a qualified, licensed clinician with any questions you have about a medical or mental-health condition, medication, or treatment. Never disregard professional medical advice or delay seeking it because of something you read on the Site.
If you are in crisis, call or text 988, call 911, or go to your nearest emergency room.
4. Affiliate Disclosure
BestOnlinePsychiatry participates in affiliate-marketing programs, including but not limited to Impact, FlexOffers, ShareASale, and direct affiliate programs operated by the providers we review (such as Klarity).
This means: if you click an outbound link on the Site and subsequently sign up for, purchase, or take another qualifying action with a provider we feature, we may receive a commission at no additional cost to you. We disclose this relationship as required by the U.S. Federal Trade Commission's Endorsement Guides (16 C.F.R. Part 255).
Affiliate compensation does not determine our rankings, reviews, or recommendations. Editorial decisions are made by our content team based on the criteria described in our Methodology and Editorial Standards. Some providers we review and recommend do not have an affiliate program with us, and we cover them on the same editorial basis.
5. License to Use the Site
We grant you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and view the Site and Content for your personal, non-commercial use, subject to these Terms. All other uses are prohibited without our prior written consent.
6. Prohibited Conduct
You agree that you will not:
- Use the Site for any unlawful purpose or in any manner that could damage, disable, or impair the Site or interfere with another person's use of the Site;
- Copy, reproduce, distribute, publicly display, modify, translate, create derivative works from, sell, license, or otherwise exploit any Content, in whole or in part, except as expressly permitted by these Terms;
- Scrape, crawl, harvest, data-mine, or otherwise systematically extract content from the Site, except in accordance with our robots.txt and with our prior written consent;
- Use the Site to train, fine-tune, or evaluate any machine-learning or artificial-intelligence model without our prior written consent;
- Misrepresent your identity, impersonate any person, or falsely state or imply an affiliation with BestOnlinePsychiatry or any provider we review;
- Attempt to gain unauthorized access to the Site, our systems, or any other user's data; or
- Use the Site to transmit malware, viruses, or other harmful code, or to engage in any form of abuse, harassment, or unlawful behavior.
7. Intellectual Property
All Content on the Site, including text, graphics, logos, images, audio, video, rankings, ratings, methodology descriptions, software, and the selection and arrangement of the foregoing, is owned by or licensed to BestOnlinePsychiatry and is protected by U.S. and international copyright, trademark, and other intellectual-property laws. "BestOnlinePsychiatry," our logos, and any associated marks are trademarks of BestOnlinePsychiatry. Third-party trademarks and provider names referred to on the Site belong to their respective owners and are used only to identify the goods or services they represent.
8. User Submissions
We do not currently host comments, reviews, or other user-generated content on the Site. If you submit feedback, corrections, or other communications to us (collectively, "Submissions"), you grant us a worldwide, royalty-free, perpetual, irrevocable, non-exclusive license to use, reproduce, modify, publish, and distribute the Submission, for any lawful purpose, without attribution or compensation to you. You represent that any Submission is your original work and does not infringe any third-party rights or violate any law. Corrections may be submitted to connect@bestonlinepsychiatry.com per our Corrections Policy.
9. Third-Party Links and Services
The Site contains links to third-party websites and services, including the websites of psychiatry providers we review. We do not control, endorse, or assume responsibility for any third-party site or service, its content, its privacy practices, or any products or services it offers. Your interactions with any third party are solely between you and that third party, and any contract you enter into with a third party is independent of these Terms.
10. Disclaimer of Warranties
THE SITE AND CONTENT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY.
WITHOUT LIMITING THE FOREGOING, WE DO NOT WARRANT THAT:
- THE CONTENT IS ACCURATE, COMPLETE, CURRENT, OR RELIABLE;
- THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE;
- THE RANKINGS OR REVIEWS WILL BE SUITABLE FOR YOUR PARTICULAR SITUATION; OR
- ANY PROVIDER, MEDICATION, TREATMENT, OR SERVICE WE DESCRIBE WILL ACHIEVE ANY PARTICULAR HEALTH OUTCOME.
YOU USE THE SITE AND ANY INFORMATION OBTAINED FROM IT AT YOUR OWN RISK.
11. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, BESTONLINEPSYCHIATRY, ITS OWNERS, OFFICERS, EMPLOYEES, CONTRIBUTORS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE SITE OR CONTENT, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100).
THIS LIMITATION APPLIES REGARDLESS OF THE LEGAL THEORY ON WHICH A CLAIM IS BASED (CONTRACT, TORT, STATUTE, OR OTHERWISE). SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OF THE LIMITATIONS ABOVE MAY NOT APPLY TO YOU; IN THOSE JURISDICTIONS, OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.
12. Indemnification
You agree to defend, indemnify, and hold harmless BestOnlinePsychiatry and its owners, officers, employees, contributors, and agents from and against any claims, demands, damages, liabilities, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use of the Site; (b) your violation of these Terms; (c) your violation of any law or the rights of any third party; or (d) any Submission you provide. We reserve the right to assume the exclusive defense and control of any matter subject to indemnification by you, in which case you will cooperate with us as we may reasonably request.
13. Governing Law
These Terms and any dispute arising out of or relating to them or the Site are governed by the laws of the State of New York, without regard to its conflict-of-laws principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
14. Dispute Resolution
PLEASE READ THIS SECTION CAREFULLY. IT REQUIRES YOU TO ARBITRATE DISPUTES WITH US AND LIMITS THE WAY YOU CAN SEEK RELIEF.
You and BestOnlinePsychiatry agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Site (a "Dispute") will be resolved by binding individual arbitration administered by JAMS under its applicable rules, except that either party may bring an individual claim in small-claims court. The arbitration will take place in New York, New York, or by video at the arbitrator's discretion. The Federal Arbitration Act governs the interpretation and enforcement of this section.
Class-action waiver. You and we each agree that any Dispute will be resolved only on an individual basis and not as a class, collective, consolidated, or representative action. If a court or arbitrator decides that this class-action waiver is unenforceable as to any part of a Dispute, that part must proceed in court and the remaining parts will proceed in arbitration.
Opt-out. You may opt out of this arbitration agreement by sending written notice within 30 days of first agreeing to these Terms to connect@bestonlinepsychiatry.com with the subject line "Arbitration Opt-Out."
15. Changes to These Terms
We may revise these Terms from time to time. When we do, we will update the "Last Updated" date above. Material changes will be highlighted on the Site. Your continued use of the Site after the effective date of any change constitutes acceptance of the revised Terms.
16. Termination
We may suspend or terminate your access to the Site at any time, for any reason or no reason, including if we believe you have violated these Terms. Sections that by their nature should survive termination (including Sections 3, 4, 7, 8, 10, 11, 12, 13, 14, and 18) will survive.
17. Miscellaneous
These Terms, together with the Privacy Policy and any other policies expressly incorporated by reference, constitute the entire agreement between you and BestOnlinePsychiatry regarding the Site. If any provision is found unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision will not be considered a waiver. You may not assign or transfer these Terms; we may assign them without restriction. No agency, partnership, joint venture, or employment relationship is created by these Terms.
